1. What This Site Is

ClearingContractors.com is an online directory of land clearing and forestry mulching contractors operating in North Carolina. We connect consumers looking for land clearing services with contractors who provide them.

The Site serves two types of users:

• Consumers: people looking to find and contact land clearing contractors.
• Contractors: businesses listed in the directory, whether or not they have claimed or paid for their listing.

2. How Listings Work

3. Requesting Listing Removal

If you are a contractor and do not want your business listed on the Site, you have the right to request removal. We respect that right and will honor removal requests promptly.

To request removal, email info@vertlyn.com with the subject line “Listing Removal Request.” Include your business name and any details that help us identify your listing. We will remove the listing within 5 business days and confirm by email.

Removal is permanent. If you change your mind later, you can request to be re-listed by contacting us.

4. Requesting Listing Updates

If information about your business is inaccurate, you may request a correction by emailing info@vertlyn.com with the subject line “Listing Update Request.” Describe what needs to be changed. We will review and update accurate information within 5 business days.

The fastest way to maintain accurate and complete information is to claim your listing (see Section 2b).

5. Accuracy Disclaimer

Listings on this Site are compiled from public sources and may not be accurate, complete, or current. We make no representations or warranties about the accuracy, reliability, or completeness of any listing information, including but not limited to business names, phone numbers, addresses, services offered, service areas, insurance status, or licensing status.

Before hiring any contractor, we strongly encourage you to verify their credentials, licensing, and insurance directly. We are a directory, not an endorsement service.

6. Consumer Use — Lead Forms

Consumers may submit contact or lead request forms through the Site to inquire about a contractor's services. When you submit a form:

• Your name, email, phone number, and message will be shared with the contractor you are contacting.
• We are not a party to any agreement between you and a contractor. Any contract, price, or work arrangement is solely between you and the contractor.
• We do not screen, vet, or guarantee the work of any contractor listed on this Site.

7. Prohibited Use

You agree not to use the Site to:

• Scrape, copy, or harvest contractor data for competing directories or commercial databases
• Submit false or misleading information through any form
• Spam or harass contractors through the lead form system
• Impersonate a contractor or claim a listing you do not own
• Attempt to gain unauthorized access to any part of the Site or its backend systems
• Use the Site in any way that violates applicable law

We reserve the right to block access for anyone who violates these rules.

8. User-Submitted Content

If you submit any content through the Site — including claim requests, listing updates, messages, or other information — you represent that:

• The information is accurate to the best of your knowledge
• You have the right to submit it
• It does not violate any law or the rights of any third party

We reserve the right to review, edit, or remove any user-submitted content at our discretion, without notice.

9. Premium Listing Payment Terms

If you purchase a premium listing, the following terms apply:

• Fees are charged as described on the Site at the time of purchase (monthly, annually, or per-lead, depending on the plan selected).
• Payments are processed through a third-party payment processor. We do not store your card information.
• Subscriptions renew automatically unless cancelled before the renewal date.
• To cancel, contact us at info@vertlyn.com at least 5 business days before your renewal date.
• We do not offer refunds for partial periods, except where required by applicable law or at our sole discretion.
• We reserve the right to modify pricing with 30 days' notice. Continued use after the effective date of a price change constitutes acceptance.

10. Our Right to Modify or Remove Listings

We reserve the right to:

• Add, modify, or remove any listing at any time, for any reason
• Suspend or terminate premium listing access for accounts that violate these Terms
• Discontinue any feature or the Site itself at any time

If we discontinue a paid premium listing without cause, we will provide a prorated refund for the unused period.

11. Limitation of Liability

The Site and all content, listings, and features are provided “as is” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

In no event shall Vertlyn, LLC, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Site, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms or your use of the Site shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Vertlyn, LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any third-party rights.

13. Third-Party Links

The Site may link to contractor websites and other third-party sites. We do not control those sites and are not responsible for their content, privacy practices, or accuracy. Linking to a site does not constitute an endorsement.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

If you have a dispute with us, please contact us first at info@vertlyn.com. We will make a good-faith effort to resolve it informally.

If informal resolution fails, any dispute shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in North Carolina. Both parties waive the right to a jury trial and the right to participate in class action litigation.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction for claims involving intellectual property or unauthorized access to the Site.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes will be announced on the Site. Continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms.
